Our Terms

1. THESE TERMS
1.1 What these terms cover. These are the terms and conditions on which we supply products to you.
1.2 Why you should read them. Please read these terms carefully before submitting your order. They explain who we are, how we will provide products, how you and we may change or end the contract, what to do if there is a problem, and other important information.
1.3 Are you a business customer or a consumer? In some areas, you will have different rights depending on whether you are a business or consumer. You are a consumer if:
– You are an individual.
– You are buying products for personal use, not for business, trade, craft, or profession.
1.4 If you are a business customer, this is our entire agreement. You acknowledge that these terms are the full agreement between us and that you have not relied on any other statement or representation.

2. INFORMATION ABOUT US AND HOW TO CONTACT US
2.1 Who we are. MiLash is a trading name of MiLash UK Limited, registered in England and Wales (company number 15071767).
2.2 How to contact us. You can contact us at info@milash.co.uk.
2.3 How we may contact you. We will contact you via the email or postal address provided with your order.
2.4 “Writing” includes email. When we say “writing,” this includes email.

3. OUR CONTRACT WITH YOU
3.1 How we will accept your order. We will accept your order when we email you to confirm it. At that point, a contract will come into effect.
3.2 If we cannot accept your order. We will inform you if we are unable to accept your order and will not charge you.
3.3 Your order number. We will assign an order number for tracking and communication purposes.

4. OUR PRODUCTS
4.1 Products may vary slightly from pictures. Although we try to display products accurately, the actual product may differ slightly from images.
4.2 Product packaging may vary. Packaging may differ from that shown on our website.

5. YOUR RIGHTS TO MAKE CHANGES
If you want to make changes to your order, contact us. We will inform you if the change is possible and if it will affect the price, timing, or other factors.

6. OUR RIGHTS TO MAKE CHANGES
6.1 Minor changes. We may make minor changes to reflect legal, regulatory, or technical updates.

7. PROVIDING THE PRODUCTS
7.1 Delivery costs. Delivery costs will be shown on our website.
7.2 When we will provide the products. We will give you an estimated delivery date.
7.3 We are not responsible for delays outside our control. If delays occur, we will inform you and take steps to minimize them. If the delay is significant, you can end the contract and receive a refund.
7.4 When you are responsible for the products. Responsibility passes to you when the product is delivered.
7.5 When you own the products. You own the product when we receive payment in full.
7.6 If you do not provide necessary information. We may end the contract or charge extra if you do not provide the necessary information for delivery.
7.7 Reasons we may suspend the supply of products. We may need to suspend supply to deal with technical issues or regulatory changes.
7.8 Your rights if we suspend supply. If suspension lasts longer than 30 days, you may end the contract and receive a refund.
7.9 Non-payment. If you do not pay on time, we may suspend delivery and charge interest on overdue payments.
7.10 Address errors at checkout. We are not responsible for non-delivery due to incorrect address entry.
7.11 Reporting non-delivery. You must report non-delivery within 5 days of the tracking showing delivery.

8. YOUR RIGHTS TO END THE CONTRACT
8.1 Your rights. Your rights depend on whether the product is faulty, if we have done something wrong, or if you have simply changed your mind (for consumers only).
8.2 Ending the contract due to our fault. You can end the contract if we change the product or terms without your consent, make an error in pricing, or delay delivery significantly.
8.3 Consumers’ right to change their mind. Consumers have 14 days to change their mind under the Consumer Contracts Regulations 2013.
8.6 Delays over 30 days. If your delivery is delayed by more than 30 days, you are entitled to a refund.

9. HOW TO END THE CONTRACT WITH US
9.1 Let us know. Contact us via email at info@milash.co.uk with your order details.
9.2 Returning products. You must return products after ending the contract.
9.3 When we pay for returns. We will cover return costs if the product is faulty or misdescribed.
9.5 Deductions for refunds. Refunds may be reduced if the product has been handled improperly.

10. OUR RIGHTS TO END THE CONTRACT
We may end the contract if you do not pay, do not provide information needed, or do not accept delivery.

11. IF THERE IS A PROBLEM WITH THE PRODUCT

12. YOUR RIGHTS IN RESPECT OF DEFECTIVE PRODUCTS IF YOU ARE A CONSUMER
Consumers are entitled to a refund for faulty products. Return the products and we will cover the return cost.

13. YOUR RIGHTS IN RESPECT OF DEFECTIVE PRODUCTS IF YOU ARE A BUSINESS
Business customers do not have a warranty.

14. PRICE AND PAYMENT
14.1 Price. The price includes VAT and will be displayed on our website.
14.2 Payment. You must pay before we dispatch products.
14.6 Late payment. We may charge interest on late payments.

15. OUR RESPONSIBILITY FOR LOSS OR DAMAGE IF YOU ARE A CONSUMER
We are responsible for foreseeable loss or damage caused by our breach of these terms.

16. OUR RESPONSIBILITY FOR LOSS OR DAMAGE IF YOU ARE A BUSINESS
Our liability to business customers is limited to the greater of £2000 or 40% of the total sum paid under the contract.

17. HOW WE MAY USE YOUR PERSONAL INFORMATION
We will use your personal information in accordance with our privacy policy.

18. OTHER IMPORTANT TERMS
18.1 Transfer of rights. We may transfer our rights under the contract to someone else.
18.6 Governing law. English law governs these terms, and you can bring legal proceedings in the English courts.
